Art from the Art, LLC, a Texas limited liability company, is the owner and operator of this website and is licensed to conduct the business of this website under the name, “KidzArt Products. Art from the Art, LLC”  (“we,” “our” or “KidzArt Products”) offers products and services under this website exclusively to customers and clients of KidzArt Texas, LLC or its franchisees (collectively, the “KidzArt Businesses”). KidzArt Texas, LLC licenses KidzArt franchisees a program for the establishment and operation of businesses that provide art instruction and products to children and adults. Each of these KidzArt Businesses is independently owned and operated. KidzArt Products and this website are not owned, operated or maintained by KidzArt Texas, LLC or any of its KidzArt franchisees, which have no responsibility or liability for either or for any products or services offered or sold on this website. Art from the Art, LLC is the sole owner and operator of this site and exclusively responsible for the site, its content, operation, the business conducted hereunder, and all matters of any kind relating to this website. The products available for order from this website are offered, sold and distributed solely by Art from the Art, LLC, which also is responsible for product quality, sales, shipping, order/payment processing, and product-related matters or any kind.

Art from the Art, LLC has the following Terms and Conditions that need to be followed by users of the KidzArt Products website. Since changes may occur, it is up to the user to review our updates.


Acceptable Use


  • The website is available for KidzArt Texas, LLC and KidzArt Franchisees and their respective clients and customers (e.g., schools public and private, preschools, daycares, church groups, children’s camp etc., and youth organizations.) The express purpose of the website is to create art galleries for children and their families. Products imprinted with children’s artwork are available for family and friends to purchase. The artwork images will be archived for the elementary years, or until this website is discontinued, whichever period is shorter. Art from the Art, LLC has no responsibility to notify customers or to return archived artwork images before discontinuing the website. If the website is discontinued, the archived artwork images will be destroyed.
  • Teachers, Parents, or KidzArt Franchisees and their employees are the only ones allowed to upload artwork into the website.

Unacceptable Use


  • Art from the Art, LLC prohibits any unlawful use of this website.
  • Art from the Art, LLC prohibits any actions on this website that would be harmful to minors.
  • Pornographic materials are strictly prohibited.
  • Art from the Art, LLC prohibits displaying actual photos of child or family members.
  • No one may use the website and act like they are employed by or associated with Art from the Art, LLC or a KidzArt Business, a teacher, and/or a parent. It is illegal for the user to misrepresent oneself as a parent and order products, or claim to have obtained parental permission when user has not done so.
  • Users may not advertise on the KidzartProducts.com website.
  • Users are prohibited from copying information from our website (schools, teachers) for the purpose of advertising.

Advertising


Art from the Art, LLC holds the right to disclose generic information, such as number of visitors, buying patterns, etc., to partners, advertisers, and other responsible third parties. Such a disclosure is limited to generic information. Your personal information will only be made available to Art from the Art, LLC and KidzArt Businesses.


Removal of Information


Parents and Teachers can opt out of participating with Art from the Art, LLC. If a parent does not want their child’s artwork online or if they want to get rid of their art gallery, they can do so at anytime by contacting Art from the Art, LLC at support@kidzartproducts.com.


Limitations of Liability


KidzArt Businesses and all of their respective managers, employees, and/or owners/officers/directors/members will not be held liable in any manner for the actions, errors or omissions of Art from the Art, LLC, the KidzArt Products website owner/operator. Art from the Art, LLC and KidzArt Businesses, all of their respective managers, employees, and/or owners/officers/directors/members will not be held liable for any punitive or consequential damages that result from people using the KidzArt Products website. If someone misuses the KidzArt Products website and violates the terms and conditions, the user agrees to indemnify and hold Art from the Art, LLC, KidzArt Texas, LLC, and KidzArt Franchisees, and all of their respective managers, employees, and/or owners/officers/directors/members, representatives, clients and customers (including, but not limited to, schools, teachers, and students) harmless from any liability to third parties to include legal fees or violation of rights to a third party.


KidzArt Products Guarantee


Art from the Art, LLC(d/b/a “KidzArt Products) offers products with children’s artwork imprinted on individual items. Items are custom made one at a time. Items will be replaced only under the following conditions:

  • Customer receives product with the wrong piece of artwork on it.
  • Items are broken or damaged.

To replace an item under the above conditions, follow the steps below:

  1. Email Art from the Art, LLC at support@kidzartproducts.com.
  2. Include the following information: your name, phone #, and mailing address, the screen name (ID#) of the child, the right art with number, and the reason for the return.
  3. Email within 10 days of receiving products.

Do not return any product ordered from this website to KidzArt Texas, LLC or a KidzArt Franchisee, as they have no responsibility or liability for the same.


Refund Policy


If you are not completely satisfied with your KidzArt Products order, return it within 30 days of shipment for a full refund. Art from the Art, LLC strives to produce great products; however we cannot replace items if the image provided is poor quality. The customer is responsible to check the artwork at time of submission or before ordering. Also, Art from the Art, LLC cannot accept a return of items if the customer ordered the wrong artwork and Art from the Art, LLC in good faith reproduced the work onto an item. Clothing items such as t-shirts will not be returned due to incorrect sizing. It is the customers responsibility to make sure clothing items are the correct size when ordered. Do not return any product ordered from this website to KidzArt Texas, LLC or a KidzArt Franchisee, as they have no responsibility or liability for the same.


Security


All site users (parents, teachers, KidzArt Businesses and other site users) who are given a user name and create a password are responsible for maintaining the privacy of the user name and password. If, for any reason, a site user has reason to believe privacy has been compromised, they must notify Art from the Art, LLC immediately and Art from the Art, LLC will change the applicable user name. Art from the Art, LLC will not be liable for any such security issue about which it is not notified.
